How does having the right expert play a critical role in the outcome of a case?

Having the right expert, you need to make sure that they have the skills and the technical knowledge. Oftentimes, the analysis that we’re doing is very complex, and it takes somebody with a certain skill set to be able to do it effectively.

But beyond that, an expert needs to be able to communicate their findings. It’s not just doing the work. It’s being able to clearly explain it to an audience that does not have that technical background and that technical knowledge.

So your expert needs to be able to do the work first and foremost but also be able to explain it to a jury.

 

 

 

What are common missteps you’ve seen in opposing expert testimony and how do you apply those learned lessons into your work?

I think the most common misstep I see from opposing experts is relying on assumptions that they are given from counsel that may not be fully supportable by the actual evidence in the case. And one of the things that we do when we’re given assumptions is we make sure we can support them first and foremost with underlying documents or evidence in the case.

And in cases where we cannot support those opinions or those assumptions, rather, we work with counsel to help them fully understand the financial picture and to bring the truth to light. That way they are able to adapt their case strategy as needed.
