Intellectual Property Damages
Overview
We quantify damages arising from allegations of violations of intellectual property protection laws. Our cases include patent infringement allegations as well as Lanham Act violations such as trademark infringement and misappropriation of trade secrets.
Intellectual property damages can also arise under other legal contexts such as attorney malpractice or breach of license agreement.
Example Cases
Perfect Company v. Adaptics Limited, 2017-2019. On behalf of the plaintiff, we developed an opinion of lost profits and reasonable royalty relating to alleged patent infringement. Ms. Morones testified at deposition.
Ameranth Inc. v. Starbucks Corp., 2018: On behalf of the defendant, we developed an opinion of reasonable royalty relating to alleged patent infringement. Ms. Morones testified at deposition.
Vesta Corp. v. Amdocs Inc., 2017-2018: We developed an opinion of the plaintiff’s lost profits resulting from the defendant’s alleged misappropriation of Vesta’s trade secrets, on behalf of the plaintiff. Ms. Morones testified at deposition.
Columbia Sportswear North America, Inc. v. Seirus Innovative Accessories 2017: On behalf of the plaintiff, we calculated defendant’s profits earned on alleged design patent infringement, as well as developed an opinion of reasonable royalty relating to alleged utility patent infringement. Ms. Morones testified at deposition and trial.
Bikila v. Vibram 2016: We developed an opinion of reasonable royalty damage due to allegations of infringement of personality rights. Ms. Morones testified at deposition.
Skedco, Inc. v. Strategic Operations, Inc., 2015: We developed an opinion of lost profits and reasonable royalty damages relating to alleged patent infringement, on behalf of the plaintiff. Ms. Morones testified at deposition.
Extreme Technologies, Inc. dba Bowtech Archery v. Rex Darlington, 2013: We calculated lost profits for alleged breach of exclusive patent licensing agreement on behalf of the Plaintiff. Ms. Morones testified at deposition.
FLIR Systems, Inc. v. Sierra Media and Fluke Corp., 2012: We calculated damages relating to alleged trademark infringement and false advertising on behalf of Fluke Corp. Ms. Morones testified at deposition and trial.
